Understanding Your Rights Under A.R.S. § 25-409

Arizona law does not give grandparents an “automatic” right to see their grandchildren, but it does provide a clear legal path to request those rights if it is in the child’s best interests.

1. Grandparent Visitation

You can typically petition the court for visitation if one of the following is true:

The child’s parents have been divorced for at least three months.
One parent has been deceased or missing for at least three months.
The child was born out of wedlock (the parents were never married).

2. Legal Custody (In Loco Parentis)

In more serious situations where a grandparent is effectively acting as the parent, you may petition for Legal Decision-Making and Placement. This is known as acting In Loco Parentis (in the place of a parent). To succeed, the court must find that it would be significantly detrimental to the child to remain in the care of either legal parent.
