How Arizona Courts Think About Spousal Maintenance
Unlike child support (which follows a formula), spousal maintenance involves two separate questions:
Does anyone qualify for it?
The court looks at whether the person asking for support meets specific criteria under A.R.S. § 25-319(A). They need to show at least one of these:

- Helped pay for the other spouse’s education or career advancement

If they qualify, how much and for how long?
The judge weighs 13 different factors, including the standard of living during marriage, length of marriage, each person’s earning ability, contributions to the other’s career, and whether someone sacrificed their own career for the family.
This is why maintenance cases that go to trial are expensive and unpredictable. Judges have enormous discretion, and reasonable people can disagree about what’s “fair.”

The Decision That Really Matters: Can It Change Later?

The court decides whether the change justifies modifying the order. It also means the receiving spouse can request the spousal order to continue in duration or increase in amount. It can cut both ways.
Non-modifiable (by agreement) – You can agree in writing (A.R.S. § 25-319(D)) that the amount and duration can NEVER be changed by a court, for any reason. It’s locked in permanently.
Non-modifiable provides certainty you know exactly what you’re paying or receiving until the end date, no matter what. But it also means no relief if circumstances drastically change. This isn’t a decision to make lightly.

Common Questions About Maintenance
Do we have to follow what the calculator says?
No. If you’re in agreement, you can settle on whatever amount seems fair to both of you. The court still wants to see the worksheet showing what the guideline would suggest, but judges routinely approve agreements that differ from guidelines when both parties consent.
When do the payments stop?
On whatever date you specify in the decree. Arizona law also automatically terminates maintenance if the receiving spouse remarries or either spouse dies, unless your agreement specifically says otherwise.
Can we agree to no maintenance even though one of us might qualify?
Yes. People waive spousal maintenance rights in settlement agreements all the time. As long as both parties agree and understand what they’re waiving, courts generally approve it.
What’s the difference between this and child support?
Completely different. Child support is for the kids, follows a state formula, and can almost always be modified when circumstances change. Spousal maintenance is for an ex-spouse, and can be made non-modifiable by agreement. They’re separate obligations with separate rules.
Can we build in automatic changes?
Sometimes. Some agreements include step-downs (payments reduce after X years) or end when specific events happen (retirement, remarriage, cohabitation). We can document these terms if you’ve agreed to them.
